1. Acceptance of Terms

1.1These Terms of Use (the “Terms”) govern your use of the Pok app for iPhone and iPad (the “App”) and the pok.run website, provided by Pok (“Pok”, “we”, “us”).
1.2By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2.1The App is an emulator that lets you play game files you provide on supported Apple devices.
2.2The App does not include, sell, distribute, host, or download any games, BIOS files, or other copyrighted software.
2.3We may add, change, or remove features of the App at any time.

3.1We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the Apple Media Services Terms and Conditions.
3.2You may not copy, modify, distribute, sell, or reverse engineer the App, except as permitted by applicable law or by the licenses of open-source components included in the App.

4.1You are solely responsible for the game files, BIOS files, skins, and cheat codes you add to the App.
4.2You may use the App only with files you legally own or have the right to use. You must not use the App to infringe the intellectual property rights of others.
4.3You must comply with all laws that apply to you when using the App.
4.4Content from third-party websites, including skins and cheat codes, is used at your own risk. We do not control or endorse such content.

5.1In-app purchases are processed by Apple and are governed by our Payment Agreement and Apple’s terms.

6.1The App, including its name, logo, design, and code, is owned by Pok, except for third-party and open-source components.
6.2Platform names, trademarks, and game titles belong to their respective owners. Pok is not affiliated with, endorsed by, or sponsored by any console manufacturer or game publisher.
6.3Open-source components included in the App are licensed under their own terms.

8.1The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.2We do not guarantee that any particular game will run, that the App will be error-free, or that your save data will never be lost. You are responsible for backing up your data.

9.1To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the App.
9.2To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the 12 months before the claim.

11.1These Terms are between you and Pok, not Apple. Apple is not responsible for the App, its content, maintenance, or support.
11.2Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11.3If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any. Apple has no other warranty obligation with respect to the App.

12.1We may revise these Terms from time to time. Changes take effect when posted on this page, and the “Last updated” date above will be revised. Continued use of the App means you accept the revised Terms.
